By accessing Franchisenet [accorfranchise.com.au] (Franchisenet), you agree to be bound by these Terms and Conditions of Use and all applicable laws and regulations. If you do not agree with any of these terms, you must immediately notify the website administrator [Franchiseaustpac@accor.com and you are prohibited from using or accessing Franchisenet. The materials contained in this website are protected by applicable copyright and trade mark law.
2. Use License
All persons who use Franchisenet have a personal, non-exclusive and non-transferrable right to view the information found on Franchisenet and the material made available on it solely for use in the operation of a hotel which is, (and only for so long as it is), a member of the Accor international group of hotels (Accor Group) in accordance with the terms of the franchise agreement entered into with AAPC Properties Pty Limited (ABN 17 065 560 885 (AAPC) and as a consequence of which you have been provided access to Franchisenet. This is the grant of a license, not a transfer of title, and under this licence you may not:
modify or copy the materials;
use the materials for any commercial purpose, or for any public display (commercial or non-commercial) other than as set out above;
attempt to decompile or reverse engineer any software contained on this web site;
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or "mirror" the materials on any other server.
3. Copyright and Related rights
The presentation and each of the elements appearing on Franchisenet, including the domain name, trademarks, logos, brand names, designs, illustrations, photographs, wording, graphics and other files, intellectual property belonging to AAPC or its Related Bodies Corporate (as defined in the Corporations Law (Cth)(2001) or are subject to authorised use only and are protected by the current laws on intellectual property.
No element forming Franchisenet may be copied, reproduced, modified, re-edited, up/down-loaded, denatured, transmitted or distributed in part or in full in any manner whatsoever in any format or medium whatsoever, without the prior written authorisation of AAPC, except as specifically permitted under the terms of any written agreement with AAPC and without any modification of any of the elements present on Franchisenet.
Any other use of the site or its elements not expressly authorised will amount to an infringement of the rights of AAPC or its Related Bodies Corporate.
4. Termination of Licence
This licence shall automatically terminate on termination of the franchise agreement pursuant to which access was provided or if you violate any of these restrictions and may be terminated by Accor at any time. Upon termination of this licence access to the website will cease, and you must destroy any downloaded materials in your possession whether in electronic or printed format.
5. Disclaimer
The materials on this web site are provided "as is". AAPC makes no warranties, expressed or implied and accepts no liability regarding use of the information on Franchisenet. AAPC hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, AAPC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
Accor SA is not responsible for the accuracy of Franchisenet, nor for any errors or omissions on Franchisenet. The user is solely liable for the use of such information.
